A 38-year-old woman has filed a lawsuit against Coastal Fertility Specialists after being implanted with the wrong embryo, resulting in her giving birth to another family’s child. The lawsuit, submitted on February 18 in a Georgia state court, states that Krystena Murray, a wedding photographer from Savannah, unknowingly carried and delivered a baby who was not biologically related to her. She only discovered the error after the child’s birth in December 2023 and was forced to relinquish custody five months later, deepening her emotional distress.
Murray had sought IVF treatment to conceive using a sperm donor who resembled her a white male with dirty blond hair and blue eyes. However, when she delivered the baby, she immediately realized something was wrong the infant was a dark-skinned African American baby. Fearing she would lose the child, Murray alerted the clinic, leading to an investigation. DNA tests confirmed the baby’s biological parents, who then pursued legal custody. In a heartbreaking moment, Murray voluntarily surrendered the child in court.
Now, she is suing the clinic for negligence and other claims, seeking damages and a jury trial. The case highlights the devastating consequences of IVF errors and raises concerns about fertility clinic protocols.
